This Privacy Policy explains how SmartNed ("we", "us") collects, uses, and protects your personal data when you visit our website or contact us for information about our products and services. We act as the data controller under the EU General Data Protection Regulation (GDPR).

1. Who we are

The data controller for this website is Amperapark Design & Build B.V., registered with the Dutch Chamber of Commerce (KvK) under number 95237011, BTW NL867053045B01, at Moutlaan 20, 7523 MD Enschede, the Netherlands.

"SmartNed" is a wordmark of Amperapark Holding B.V. (KvK 71376518), used by Amperapark Design & Build B.V. under licence.

2. What data we collect

• Lead form (/get-started): company name, email, phone number, and the configuration details you submit (solution, number of chargers or carports, contract length, kWh rate). Contact name and country are optional.
• Attribution data submitted with the form: the page you arrived on, the referring URL, the language you were browsing in, and any UTM parameters (utm_source, utm_medium, utm_campaign, utm_term, utm_content) present in the URL. We use this to understand which channels reach customers.
• Contact interactions: information you share when you call, email, or visit our office.
• Technical data: IP address, browser type, and pages visited. See our Cookie Policy for details.

3. Why we process your data

• To respond to your enquiry and prepare a quote (legal basis: pre-contractual measures, GDPR Art. 6(1)(b)).
• To deliver and manage the services you purchase from us (legal basis: performance of a contract, Art. 6(1)(b)).
• To run and secure this website (legal basis: legitimate interests, Art. 6(1)(f)).
• To comply with legal obligations, such as tax and accounting requirements (Art. 6(1)(c)).

4. Who we share data with

We share personal data only with processors and group companies that help us run our services. Each processor is bound by a data processing agreement and may only use data on our instructions. We do not sell personal data. Processing takes place within the European Economic Area.

• AmperaPark group companies: Amperapark Holding B.V. and other operating companies in the AmperaPark group (registered at Moutlaan 20, 7523 MD Enschede). Where necessary to deliver your contract or respond to your enquiry, personal data may be shared between these companies on a need-to-know basis. Group sharing stays within the AmperaPark group; no data is transferred to third parties for this purpose.
• Hosting: Hetzner Online GmbH, Gunzenhausen, Germany. Servers are located in Nuremberg (DE).
• Email delivery: Scaleway SAS, 8 rue de la Ville l'Evêque, 75008 Paris, France. Used to deliver transactional email such as enquiry and quote confirmations. Scaleway servers are located within the European Union.
• Accounting and bookkeeping: required to comply with Dutch tax law.

5. How long we keep data

Lead enquiries are retained for up to 24 months after the last contact if no contract is concluded. Customer records are retained for the duration of the contract plus the periods required by Dutch tax and commercial law (typically 7 years).

6. Your rights

Under the GDPR you have the right to access your data, correct it, erase it, restrict or object to processing, and receive a portable copy. You can exercise these rights by emailing info@smartned.eu. If you believe we are not handling your data lawfully, you may also complain to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

7. Security

We use TLS encryption in transit, access controls, and regular backups to protect personal data. No method of transmission or storage is completely secure; we work continuously to maintain appropriate safeguards.
